Please read these terms and conditions carefully.
Palm Tree Travel, LLC (“DBA as BeyondBoraBora.com”) facilitates the purchase by customers of travel-related services, accommodations, Transportation, Entertainment, recreation, and travel packages for which Travel Related Services are provided by providers unrelated to and having no connection to Palm Tree Travel. In utilizing the services of Palm Tree Travel to book, reserve, and pay for Travel Related Services, you, the customer, agree to be bound by these terms and conditions which describe the terms and conditions by which Palm Tree Travel will agree to provide its services to Customer.
Quotation Period
All Quotations given to our clients include a detailed day-by-day itinerary accompanied by this Proposal. The timing details will be subject to change and should only be taken as an indication in the quotation period. The effort involved in this can be time-consuming, but it does ensure we deliver a highly customized itinerary. For this reason, we do not itemize or break down the pricing of our itineraries. We are happy to modify this itinerary to suit your needs better, remember we are putting this quotation together based on our initial consultation and an idea we came up with to match your needs. Budgets, standards, etc., can all be changed.
Definitions
- Acceptance: A deposit for a booking constitutes the Customer’s acceptance of these Terms & Conditions.
- Deposit: Bookings require a minimum 30% per person deposit to hold reservations. Some tours will require a larger deposit. Customers will be notified if a larger deposit is required. Deposits are NON-REFUNDABLE.
- Payment: Full payment is due 60 days before departure. Some excursions or accommodations require earlier payment. Customers will be notified if earlier payment is required. If the full payment is not paid by the stipulated date, Palm Tree Travel reserves the right to cancel the booking(s) without further notice or a refund of the deposit.
Cancellations
Cancellation penalties may vary depending on the products booked.
- Customer cancellation before the full payment due date will incur a loss of the non-refundable deposit specified above.
- Customer cancellation on or after the full payment due date, but more than 7 days before departure, will incur a penalty equal to 50% of the total booking cost.
- Customer cancellation within 7 days before departure is non-refundable.
- Insurance purchases are NON-REFUNDABLE.
- The minimum cancellation fee that will be applied is 30% per person (your non-refundable deposit).
Airfares **Important**
PALM TREE TRAVEL DOES NOT ISSUE INTERNATIONAL AIRLINE TICKETS.
- Final Payment & Documentation: Final Payment will be due 60 days before travel. Once payment has been received your e-documents will be issued and sent to you electronically approximately 3 weeks before your departure. It is the Customer’s responsibility to check your documentation carefully and call us with any queries you may have. Hard copies can be provided for a $30 fee.
- LOYALTY POINTS FOR HOTELS: Beyond Bora Borea can NOT make reservations for you with your points period. Including but not limited to, IHG, Marriott, and Hilton. Beyond Bora Bora will not take responsibility for bookings made by travelers.
- Insurance: All passengers are STRONGLY URGED to take out adequate travel insurance coverage to protect themselves against cancellation due to illness before or during travel. travelers can visit the [Zicasso Travel Insurance](https://www.zicasso.com/travel-insurance) page where Customers can directly request an insurance quote.
- Prices: Palm Tree Travel quotes prices in US currency based on the exchange rates for the respective foreign currency, usually Pacific French Franc, Australian or New Zealand dollars, as of the date of the quote. Exchange rates fluctuate. The customer’s exchange rate is only fixed when full payment is made unless otherwise noted on the Customer’s itinerary. Any price that Palm Tree Travel quotes is subject to change without notice until full payment is made unless guaranteed in writing with a specific expiration date.
- Children: Please note; that some travel products do not allow children below a certain age. If the Customer plans to travel with children, the Customer must notify Palm Tree Travel when booking.
- Names/Passports/Visas: Please ensure the names printed on your quotation are exactly as they are printed on your passport, and it is valid for 180 days AFTER you travel. The airlines will not permit a passenger to board holding a ticket that does not match the passport EXACTLY (First Middle and Last Name). A passport is required for travel to Australia, New Zealand, Tahiti, Cook Islands, Fiji, and any of the South Pacific Islands. Visas are also required to enter certain countries. If you are traveling on anything other than a US Passport you must advise your consultant of this. If you fail to check that names are spelled correctly and tickets are issued with an incorrect name, it will be at your expense to have these tickets reissued. NZ and Australia require a Visa that can be applied for on the specific country’s website.
- Limitation of Liability: Palm Tree Travel shall not be liable for any claims, losses, damages, costs, expenses, delays, sickness, injury, or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond Palm Tree Travels’ or a Service Provider’s reasonable control. In no event will Palm Tree Travels’ liability exceed the total amounts Customer paid Palm Tree Travel for Customer’s travel. Palm Tree Travel assumes no responsibility for lost tickets, documents, passes, or coupons.
- Relationship of the Parties: Palm Tree Travel shall be deemed an independent contractor for all purposes under these Terms & Conditions. Palm Tree Travel is acting solely to facilitate the reservation and purchase of Travel Related Services and is not acting in any other capacity with either the Customers or the Service Providers, including, but not limited to, any partnership, joint venture, co-ownership, or agency relationship of any kind with any Customer or Service Provider. Palm Tree Travel has no control over the quality, timing, safety, or legality of any Travel Related Service reserved or purchased by or for a customer. Palm Tree Travel cannot control whether a Service Provider represents its products accurately or fulfills any agreement or obligation with any customer.
- Disputes & Indemnity: Palm Tree Travel is not involved in providing Travel travel-related services for the Customer. Any disputes between a Customer and a Service Provider are solely between that Customer and that Service Provider and the Customer should handle all such disputes directly with that Service Provider. If the Service Provider or Customer contacts Palm Tree Travel relating to any dispute between the Customer or Service Provider, Palm Tree Travel may, in its sole discretion, facilitate dispute resolution and reserves the right to take any action that Palm Tree Travel deems appropriate under the circumstances. Customer agrees to release Palm Tree Travel and its agents and employees from claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. Furthermore, Customer agrees to indemnify, defend, and hold harmless Palm Tree Travel from any liability, loss, claim, and expense, including reasonable attorney’s fees, arising out of or in any way connected with such disputes.
Validity: These Terms & Conditions are valid until further notice in writing from Palm Tree Travel.
